ITC Hotels Limited (“ITCHL”, “we”, “our” or “us”) is offering, inter alia, Tokenisation Services (“Tokenisation Services”), in association with third party partners through which users of the platform (“User” or “you”) may tokenise their valid credit cards issued by authorised card issuers (“Card(s)”) for the purpose of future payment transactions.
By proceeding to use Tokenisation Services, you signify your consent to avail Tokenisation Services and to be bound by these terms of use (hereinafter “Tokenisation Terms”).
In the event of reservations made against Reward Nights (i.e. Members redeeming Green Points against a reservation), Tokenization services shall not be applicable.
We reserve the right, in our discretion, to make changes or modifications to Tokenisation Terms at any time for any reason. We will alert you about any changes by updating the ‘Last updated’ date of these Tokenisation Terms and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Tokenisation Terms to stay informed of updates. You will be subject to and will be deemed to have been made aware of and to have accepted, the changes in any revised Tokenisation Terms by your continued use of Tokenisation Services after the date such revised terms are posted.
1.1. “Cardmember” shall mean the User to whom the valid Card has been issued by an authorised card issuer.
1.2. “PAN” means the primary card account number that identifies card issuer and particular Cardmember account.
1.3. “Token” means a surrogate value which corresponds to a PAN.
1.4. “Tokenised Card” shall mean the Cardmember’s Card for which unique Token has been assigned.
1.5. “Tokenised Card Transaction” shall mean the transaction effected by using the Tokenised Card.
1.6. “Token Requestor” shall mean ITC Hotels Ltd or ITCHL’s service provider which is acting in the capacity of token requestor with token service provider for providing Tokenisation Service.
1.7. “Tokenisation Service” shall mean the service of replacement of actual Card details of Cardmembers with Token; and other processes involving Tokens which shall include but not be limited to transaction processing or deregistration of Tokens.
1.8. “User” shall mean any natural or legal person who is a resident of India, at least 18 (eighteen) years of age who is eligible to contract within the meaning of the Indian Contract Act, 1872, and is not undischarged insolvent
2.1. The Cardmember acknowledges and agrees that:
2.1.1. The Cardmember may initiate a request to Token Requestor for tokenisation of Card after providing explicit consent.
2.1.2. Token Requestor will collect relevant data including Card details and share the same with its third-party partners, card issuers and/or card networks for the purpose of providing the Tokenisation Services.
2.1.3. ITCHL, card networks, card issuers and ITCHL’s third-party partners will have the right to use, transfer and process the data collected from you by ITCHL to provide the Tokenisation Services. ITCHL, card networks, card issuers or ITCHL’s third-party partners in their sole discretion, shall allow or deny tokenisation of the Card on the platform and such decision of ITCHL, card networks, card issuers or ITCHL’s third-party partners shall be final and binding on the Cardmember.
2.1.4. The use of the Tokenised Card may be subject to certain transaction limits (whether in value or number of transaction) imposed, from time to time, by your card issuer or in terms of the applicable law or internal policies and procedure of your card issuer, card network or ITCHL.
2.1.5. The laws of India without regard to the principles of conflict of laws will govern the Tokenisation Services and any dispute of any kind that may arise between you and ITCHL. The Cardmember will at all times adhere to all applicable laws, rules, and regulations applicable to use of the Tokenisation Services.
2.1.6. The Cardmember shall be solely liable for all losses in case of misuse of the Tokenised Card by someone who obtained access to the Tokenised Card with the consent of the Cardmember.
2.1.7. The Cardmember hereby agrees that the Cardmember is aware of the various risks (including, without limitation, fraudulent usage of Tokenised Card) associated with usage of the Tokenised Card. The Cardmember hereby agrees and undertakes to assume and bear all the risks involved in respect of Tokenised Card and usage of the same and ITCHL shall not be responsible in any manner for the same and shall also not be liable for any claims, loss, damage, cost or expense and liability arising therefrom or in connection therewith.
3.1. The Cardholder may request ITCHL to suspend/stop/delete/terminate/close the Token after the stay of the Cardholder at the hotel and not use the features thereof any longer. The Cardmember hereby acknowledges and agrees that the termination of the Token will not terminate, suspend, close or in any other manner affect the underlying PAN or any payment or other obligations arising therefrom.
4.1. You agree that (i) all risks arising from online transactions using Tokenised Cards will be borne by you; and (ii) Tokenisation Service is provided on ‘as is’ basis.
4.2. ITCHL and any third-party partners make no warranty, express or implied regarding the quality of the Tokenisation Services including but not limited to the following: i) the Tokenisation Services will meet your requirements; ii) Tokenisation Services will be uninterrupted, timely or Error free; or iii) any products, information or material obtained by you in connection with the TOKENISATION Services will meet your requirements.
5.1. Cardmember agrees to defend, indemnify, and hold harmless ITCHL and/ or its associate entities, their officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from the Cardmember’s use of Tokenisation Services.
5.2. In event shall ITCHL, or its employees, agents or affiliates be liable for any damages whatsoever (including, without limitations, incidental and consequential damages, lost profits, or damage to computer hardware or loss of data information or business interruption) resulting from the use or inability to use the Tokenisation Services, whether based on warranty, contract, tort, or any other legal theory.
5.3. The Tokenisation Terms shall be construed and interpreted in accordance with the laws of India. The Courts of the city of New Delhi shall have exclusive jurisdiction to try all the disputes arising out of these Terms.
5.4. The Customer is not paying any charges for availing the services of tokenisation.
1. ITC Hotels Limited (‘ITC Hotels Limited/us’) respects an individual's right to privacy. This policy lays down our practices with respect to collection, confidentiality and disclosure of Personal Information. Please familiarize yourself with our privacy practices, as given below. We are an organisation based and existing in India and are thus bound by the laws of the Union of India. This Privacy Policy has been prepared in accordance with applicable Indian laws.
2. Should you choose to share your Personal Information with ITC Hotels Limited, it will be assumed that you have consented to the collection of Personal Information and the processing thereof in terms of this policy (“Privacy Policy”).
What is collected
3. We may collect Personal Information (‘Personal Information’) from you such as:
a) Personal contact details such as name, alternate name, title, addresses, telephone numbers, and personal email ID
b) Date of birth, age, anniversary and/or special occasions
c) Gender
d) Marital status
e) Nationality, country, city details, device related information such location, IP address, device id, mobile OS details etc
f) Next of kin and emergency contact information, pseudonymous email address
g) Copy of Government issued ID Card, as applicable on the location of the hotel
h) Copy of Passport and Visa as applicable on the location of hotel
i) Reservation information and travel itinerary such as duration of stay and other related details and your Marriott and/or Club ITC and/or other loyalty program membership ID/details
j) Photographs
k) Bank account details, credit/debit card information
l) CCTV footage and other information obtained through electronic means such as door access records, internet systems (including wired or wireless networks that collect data about your computer, smart or mobile device), card key, POS devices, and other security and technology systems in the Hotel.
m) Information about your use of our information and communications systems
n) Preference and interests including but not limited to dietary preferences, allergy details, health condition, and any special requests made by you and observations about your service preferences (including room and food preferences)
o) Information about how you use our services (online and at the hotel) and about how you use our website/mobile application.
p) Additionally, in some circumstances, we may also collect:
- Voice Recordings: This includes recordings of your interactions, such as customer service calls, which are captured for quality assurance purposes.
4. While collecting any Personal Information, ITC Hotels Limited indicates the purpose of collection of such information and gives the person providing the information an option of not providing the information. In such cases, ITC Hotels Limited may choose not to provide any services/supply goods for which the information was necessary. You hereby accept and agree that we shall not be held liable in any manner whatsoever if we are unable to perform our services or if there is a deficiency in our services to you due to your failure to provide such information.
7. Without limitation, Personal Information collected by us may be used by us for the following reasons:
a) To enable your use of the services available at our hotels and restaurants;
b) Where we need to perform the contract we have entered into with you;
c) Where we need to comply with a legal obligation;

e) To send loyalty Point statements, invoices and payment reminders to you, and collect payments from you;
